No, the data directory is the way quake/ nexuiz works.. the server also transmits that name to the client on connect.. its just fucked up that osx overwrites the directory.. no other OS does that.
The readme for the patch is fine, but how many people will read it? :)

Yes, you are right, but we can't do that, otherwise the zip won't be usable for non-Macs any more.

We COULD include a script that puts the data into the .app that you can call first, but I know nobody who is voluntarily using AppleScript.

If you want to see why nobody wants to program in AppleScript... EAT THIS: http://www.google.com/codesearch?hl=en&q=show:LbfTFfkcp7c:2AH25PrbxrA:wbtCcxszEKg&sa=N&ct=rd&cs_p=http://gentoo.osuosl.org/distfiles/wxPython-src-2.6.1.0.tar.gz&cs_f=wxPython-src-2.6.1.0/docs/mac/M5build.applescript - How can anyone volunteer to program in SUCH a language?
1. Open Notepad
2. Paste: ÿþMSMSMS
3. Save
4. Open the file in Notepad again

You can vary the number of "MS", so you can clearly see it's MS which is causing it.

Adding it as comment to the zip file might work. At least all zip programs i know show the comment when extracting, but i wouldn't be surprised if macos is messing that up, too...

You definitely have some other problem as the others in that thread here were bitten by a strange osx behavior when overwriting directories.
You just installed 2.2.3 and its not working.. though are you sure you downloaded the full version and not the patch by mistake? So your download was around 200mb right? Just to make sure you did not click on the wrong link :)
