Unauthorized use of my music.

  • "If free content means to deal with rude people like you, nobody wants to make free content. Especially in your case. Believe me - if we could revoke your license to play and distribute Nexuiz, we would have done so after all you've done - after all, you are opposing human rights, that is, basic rights of freedom, and thus don't deserve the right to use free (as in speech) software. "

Then change the license to non-gpl Div, (and another project will spring up from the last GPLd fork). And guess what, I'd still use nexuiz just to spite you, even if it ment going to court against you.

Divv: Get out of opensource if you want to restrict who uses your work. Get out and stay out. We do not need submariners.

I am against women's rights. But I am not against anyone (women including) using or changing my work and redistributing it in ANY way they wish (which is why I gpl my work).

You seem to be (from your statement) against men like me using your work.

PS: I do models, music, textures, you name it... if you weren't so stuck on anti-men pro-women beliefs maybe others would join you. People willing to work for free tend to be 'eccentric'. You alienate more people saying "if we could relicense and stop you from using our work we would".

I will continue to use the awsome music track as long as it is GPLd.

The GPL cannot be recinded. Sure you, as the copyright owner, can relicense other copies of your work to other people (say a commercial license for a cd presser) but you cannot ever recind that GPLd copy. EVER.

PS: I didn't know the author of the Adonthell music because it wasn't made clear enough to me, I just knew that the whole project was GPL (and checked this again). Perhapse he didn't intend to do this but if he didn't explicitly state to the other (he's a dev too as he contributed) devs that these files are under a diffrent license then they stand with the rest of the files as GPL.

I've contacted the author yesterday, no response.

Wow one day.. do you think people have nothing else to do then answer your mails?

You mr. mikeusa have caused more trouble to Nexuiz (might i cite the debian-includsion) then anyone else! Now you are threading people doing freesoftware stuff...
Wanna talk about submariners? Oh do do make me laugh.. Basically this whole thread shows that you yourself are big submariner with your being unable to understand people and unable to be nice and respect other people.
So what was you talking about again? ah yes.. submariners (like you) and that you do not like them..

So my private opinion about you in words an american should understand.. get fucking lost idiot!

I did not say that we are going to change the license, as you are right in that it effectively can't be changed.

But people like you DO reduce the likelihood that any other project - by us or by others - will be free. It is called "learning from mistakes".

You seem to be (from your statement) against men like me using your work.

Actually, yes, I am. We can't prevent you from using it, and we know that. We are both pro human rights (for EVERYONE, not just half of them!) and pro free software. We do NOT want to make the impression that you are one of us - because that would give the message that "Alientrap is discriminating against half the wolrd population".

But when you say "men like you"... I hope this is plural by accident. One of you is more than enough.

PS: I do models, music, textures, you name it... if you weren't so stuck on anti-men pro-women beliefs maybe others would join you.

If you weren't so stuck on anti-women beliefs someone may actually take content you make. Gung vf, vs vg nyfb ybbxf orggre guna jung lbh unir ba lbhe jrofvgr...

    The GPL cannot be recinded.

Actually, this is wrong according to German law and probably to some other countries' law too. One CAN revoke the license because of a "change of beliefs". However, when you do that, you'd have to compensate anyone affected by your revocation of the license, which is impractical in case of the GPL as it would usually mean paying millions or even billions. Even finding out WHO is affected by such a revocation is practically impossible if it was a free project. However, this could be used to remove the GPL from a work - but not to revoke the rights any specific person has due to the GPL. Which is exactly why it's practically impossible to actually do.

And as for the actual case: did you at least ask the adonthell authors? If you did and if they told you that you can use the music, this is not your fault. But - I suppose you did NOT ask the adonthell authors.

  • I didn't need to ask the adonthell authors, they had the license right there in their package. I looked and it was GPL, I looked in other directories to make sure there were no other licenses on the music etc.

In America you can't recind licenses like the GPL. Germany is not the king of the world.

So you've learned from your mistake and won't put new projects under the GPL (is this correct?) ? That's too bad but if you are more pro-women's rights the pro-free/opensource software and content then good by and good luck.

It's great to not have pro-women's rights people in opensource. That is one of the benifits of OSS: it's mostly a men's club and a surprising number of said men are atleast somewhat opposed to women's rights/feminism.

The entrance of political women and their male fawners in any number to a field brings degradation and death to it. The free software/opensource movement is about doing rather then feeling.

Try the mailing list anti-feminism@yahoo.com if you want to see that there are more men like me. A new anti-women's rights group springs up everyday. The two indian (from India) free-software programmers are against women's rights and hate how it has transformed society.

So, if you think that because men like me inhabit the free software sphere (it wasn't the liberal complete intolerance against non-feminist sphere you thought it was) and we use and extend your work in accordance to the opensource/free software philosophy that your experiment with the GPL and freesoftware was a mistake... well:
What can I say but that is not the most enlightened thing I've ever heard (note: the enlightenment fathers were in favor of men's rights but also infavor of the witch trials (who were pro-women's rights)).

    When taken in context
(To kill a remote user, it is sometimes better to use the
command telnet(1c) using the standard xkilld port (number
    666).)

That is a death threat. It may be actionable.

Don't correct his spelling. He is an American, so English isn't his native language ;)

Seriously, it appears to be a common pattern that Americans are especially bad at English spelling.

OTOH people sometimes even "insulted" me by calling me a native speaker... which I am not, and proud of not having elected GWB ;)

Um, don't start stereotyping and bashing Americans based on a few bad examples. Any type of broad categorization like that is just wrong.

Btw, has anybody ever heard of "typos". I take no sides in this, but I think that the way MikeUSA is being attacked is silly. His views are one thing, but natural mistakes and his passport are something else.

Yes, and I do know the true reason behind this pattern. Native speakers care less about spelling stuff correctly. As simple as that, and not an insult at all - they just see their language a different way.

It is the very same with German on chat or forums.

Bring it to court, bring it on. Wanna see the lawyer who can talk to you for more than a minute.

Seriously... I really doubt it counts as a death threat. It would be just as much of a death threat as "When you don't shut up, I'll throw pink cotton balls at you until you die". Actually, it is more likely that your lawyer would die of laughing at you.

Oh, and another alternative death threat, especially for you: if you don't shut up, I will press this button to send a message to Ford and nobody will give you a lift when the Vogons come. Take this!

I think the way they're giving you shit undermines the valid reason for them to do so (you do come off as an asshole) and I pointed that out on your behalf, but to threaten legal action based on a comment in a forum is just stupid.

  • So what's the consensus:
    GPL'd by unilateral mistake.
GPL'd because you can't recind a License such as the GPL.
Too risky even if originally GPL because it's a He said She said between artist and Adonthell (no proof).
Propriatary because Author never did GPL it.
Propriatary because Author has the final say.

BTW: I did file bug reports about adonthell-data and wesnoth-music (his music is in that package too) so they should be removed from Debian soon because they might not be open.

Donations of non-free/open media/code to open projects is no help at all.

This and the wesnoth "donations" are submarine tactics which put free projects in legal jepordy.

Why is it that most artists, when (if, they rarely do) contributing to OSS projects and not saying otherwise, assume that their contribution is "higher" and thus not subject to the same licensing as every other file in the project? They aren't "better" then the programmers who made the thing possible in the first place.

    But many think they are.
I make art myself: it's not so diffrent then programming.
Especially digital music (when you can edit Midis).

Divverent: I'm glad you have decided to not contribute to FLOSS anymore (well I'm not really, but let's run with it). If you're not committed to the cause... well it's just not for you. Get a job with say Unreal and make fully proprietary things please. You'll make money doing that and won't have to have people you POLITICALLY DISAGREE WITH ever use your media/art/code! Wouldn't that be great for you! Get out of OSS if you disagree with it please.

Thanks for what you have made though. We now how a great 3d game with great textures, and along with the rest of the opensource textures out there, pretty much have enough to make and world we wish to fight in. Thank you for that. But as you have stated, it was a "mistake".

Enjoy your life in the proprietary world, please uninstall Linux and use win or mac. There you won't even know the politics of any other collegues/devlopers (if they voice them, they get fired).

  • Now you made me really angry.

I will continue to use and contribute to OSS, because I do not want to make others suffer from the likes of you.

HOWEVER: I know NO SINGLE OSS contributor that is as radical as you. Human rights and freedom, not just freedom of code, are a general consensus among the OSS community - and human rights both for men and women.

And yes - I do see you as being just as bad as a Neonazi. Discriminating against and even imprisoning (that is, removing of elementary freedom rights) Jews or women... makes no difference to me.

And no, I would not want to work with a Neonazi just as much as I do not want to work with you. And I suppose everyone here will agree.

Okay, I have finally invoked Godwin's Law. I admit, I lose. Can we stop this thread now?

It's exactly this kind of retarded overzealous behaviour which gives certain Linux distros a bad reputation. Unfortunately Debian is one of the distros most frequently inflicted by it. There's always some minor-genius with a personality disorder at the root of it, in this case MikeeUSA/Penguin/person/person2/person3/being/being2.

Seeing how you've already been banned from the Debian mailing lists, are you now trying to get banned from a bug tracker too?

Perhaps we need to get in touch with Apache and get something hardcoded into Apache to stop him, like comments on every line saying how great women are and how we value them on many intellectual levels.
